Welcome to ESSA UK. These Terms of Service (“Terms”) govern your use of our website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our website.

2. Eligibility to Purchase

By placing an order on this website, you confirm that:

• You are at least 18 years old, and

• You are legally capable of entering into binding contracts under UK law.

3. Products and Descriptions

We take reasonable care to ensure that all product descriptions, images, and prices are accurate. However:

• Product images are for illustrative purposes only.

• Minor variations in colour, packaging, or design may occur.

• All products are subject to availability, and we reserve the right to discontinue any product at any time.

4. Prices and Payment

• All prices are listed in GBP (£) and include UK VAT where applicable, unless stated otherwise.

• Shipping costs are shown at checkout.

• Prices do not include any customs duties, import taxes or handling fees that may be charged by the destination country on international orders (see section 6).

• Payment must be made in full at the time of purchase, using the secure payment methods displayed on our checkout page.

5. Order Acceptance

Your order constitutes an offer to purchase. A contract is formed only when we confirm dispatch of your order.

We reserve the right to refuse or cancel any order for reasons including, but not limited to:

• Product availability

• Pricing or description errors

• Suspected fraud or unauthorised transactions

• Delivery to a destination we do not currently ship to (see section 6)

If your order is cancelled by us, you will receive a full refund.

6. Delivery

Our Shipping Policy forms part of these Terms. In summary:

• Orders placed before 12:00 PM on a working day are dispatched the same day; otherwise the next working day. Please allow 1 working day of handling time.

• UK orders are sent by Royal Mail Tracked 48 and are usually delivered within 2–4 working days after dispatch. Delivery times are estimates provided by Royal Mail and are not guaranteed; in some cases delivery may take up to 15 working days.

• Free UK delivery applies to orders of £20 or more; orders under £20 are charged £3.65. Optional faster services are available at checkout: Next Day+ (Royal Mail Tracked 24, £4.65, not guaranteed) and Guaranteed Next Day (Royal Mail Special Delivery, £11.45), both requiring an order before 12:00 PM on a working day.

• We are not responsible for delays caused by events beyond our control (e.g. courier delays, customs, strikes, severe weather).

• Lost parcels: Royal Mail does not treat a parcel as lost until 10 working days after its due delivery date. Where a parcel is lost, we open a claim with Royal Mail and issue a refund or replacement once Royal Mail confirms the loss. We are unable to refund or replace a lost parcel before Royal Mail has completed its investigation.

• International orders: Europe is charged per item by Royal Mail zone (£10.99 / £11.99 / £14.99 per item) and the rest of the world per item by zone (£21.99 / £24.99 per item), as shown at checkout and detailed in our Shipping Policy. Any customs duties, import VAT or handling fees are the sole responsibility of the recipient. ESSA UK accepts no responsibility for such charges. Due to customs clearance issues we do not currently ship to Belgium, Bulgaria, Spain or Italy.

• Risk of loss or damage passes to you once the goods are delivered to you or to a person or place nominated by you.

7. Returns and Refunds

Our Return & Refund Policy forms part of these Terms.

Under the UK Consumer Contracts Regulations, you have the right to cancel your order within 14 days of receiving your goods. Full details, including the return address, model cancellation form and our process for lost parcels, are available on our Return & Refund Policy page.

8. Faulty Goods

If goods are faulty, not as described, or not fit for purpose, your rights are protected under the Consumer Rights Act 2015. In such cases, you may be entitled to a repair, replacement, or refund.

9. Intellectual Property

All content on this website, including text, images, logos, and designs, is the property of ESSA UK or its licensors. You may not copy, reproduce, distribute, or use any content without our prior written consent.

10. Limitation of Liability

Nothing in these Terms limits or excludes our liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

• Any matter that cannot be excluded under UK law

To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from the use of our website or products.

Your personal data is handled in accordance with our Privacy Policy and UK GDPR.

12. Changes to These Terms

We reserve the right to update or amend these Terms at any time. Any changes will take effect once published on this page. The Terms in force at the time you place an order will apply to that order.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, nothing in this clause affects your statutory rights.
